Talent Scout Agreement
This agreement is between Casting America (Company) and ____________________________________ (Talent Scout).
The Talent Scout agrees to:
1. Represent and sell the Company's services, including talent web pages, on camera acting seminars, stunt workshops, model training, photography and merchandising.
2. Accurately represent and state Company policies to all potential and present clients.
3. Promptly mail in all orders to the Company.
4. Inform the Company of all problems concerning Company clients.
5. Inform the Company if the Talent Scout is representing, or plans to represent any other competitive firm. In no event shall the Talent Scout represent a competitive company or services without the expressed permission of the Company.
6. Telephone or email the Company with reasonable frequency to discuss sales activity within the territory.
7. Maintain ethical behavior at all times. Talent Scout will abide by the Company's Code of Ethics.
8. Never make claims of being an employee of the Company, as the Talent Scout is an independent agent working for his or her self. The Talent Scout may use the Casting America logo on his or her business card only if he or she has paid for and been cleared through a background check. The talent Scout may not at any time use the term "agent" or "coordinator" as a job description on said card.
The Company Agrees to:
1. Pay the following commissions to the Talent Scout:
Note: the determining factor between 15% and 20% commissions is the payment of the prospective scout to have a background check completed - and payment for formal training.
a. 15% - 20% of all prepaid sales - shipping, handling and taxes are not included in these calculations.
b. 15% - 20% of all credit sales - meaning 15% - 20% of that portion which has been paid, as it is paid.
c. 15% - 20% of the amount earned by the Company on talent placements of talent secured for the Company by the Talent Scout.
d. 15% - 40% of the net profits generated for special events, searches and training conducted by the Company in a geographical area where neither Casting America nor its associated affiliates has direct offices and where the Talent Scout has personally paid for all of the advertising, marketing and facilities required for said event. (This portion of the opportunity is available only to scouts who have completed the background check and have paid for formal training.)
2. To negotiate in advance of sale the commission percentage to be paid on all orders that the Company allows a quantity discount or other trade concession.
3. Commissions on refunds to customers or merchandise returned by the customer in which a commission has already been paid to the Talent Scout shall be deducted from future commissions to be paid to the Talent Scout.
4. This constitutes the entire agreement.
5. This agreement shall be binding upon all parties and their successors and assigns. And it shall be enforced under Florida law and disputes settled through the Florida court system.
